Fair use on ms-wiki

Hi! An you know ms-wiki allows fair use. But there is no information about that here m:Non-free_content#Wikipedia. As I understand it ms-wiki has this page about fair use: Wikipedia: Kandungan tidak bebas but it seems to me that this page is more a general page about fair use and not a specific guide like the en-wiki version for example: en:Wikipedia:Non-free content criteria. If I have got that part right perhaps a formal Fair use policy / Exemption Doctrine Policy (EDP) should be developed per this Resolution: Licensing policy. Yeah, they can comment at the talk page. We don't really use a specific template for image deletion, but see Templat:Deletable file. Normally the general one is sufficient though, so take your pick. As I'm sure you've noticed, plenty of files here are incorrectly tagged (or missing tags completely). As such, I do not think the idea is currently practical. I created Kategori:Deletion checked by MGA73 - will that be a help?

I also copied a tool for easy categorization to ms-wiki - see [1] and the next edits for an example. It adds a "(-) (±) | (+)" next to the categories and you can just click the + to add a category etc. --MGA73 (bincang) 10:23, 1 Mei 2011 (UTC)

I noticed you killed a lot of files today :-) Cool. I have been thinking about this. I'm also an admin on en-wiki and lb-wiki only to help with files (I'm also an admin on da-wiki and commons). If you are interessted to have more admins to help with files both Zscout370 (admin on en-wiki Commons + global admin for those who has opted in for that) and I know about files. And speaking from my view, there are a lot of images that turn out to be copyright issues (http://ms.wikipedia.org/w/index.php?title=Fail:AlWafeerB747.jpg is an example). I would like to help with the images in any way possible, but if many of the admins at the Malay Wikipedia are not able to devote time to it, I want to focus on it. My priority is removing duplicate and (copyright-wise) problematic images. Files in "Gambar Commons" don't really harm anyone so there's no rush. However if the two of you want (to temporarily become admins) to mass delete these files, I don't think it's my decision. Sure... Just wanted to hear your opinion. Admins (temporarily or not) should always be approved by the editors! The reason I think it is good to delete "Gambar Commons" files is that they are also in the other categories and therefore we may risk check the same files over and over. Also it seems that if a category has many files not many users will check the files. For en.wikipedia, I usually delete the image immediately after moving. Other admins, I would say about a week (but we also have few admins that work on images there). Zscout370 (bincang) 12:24, 4 Mei 2011 (UTC)

They can be delete as soon as an admin has checked that the information has been transferred correctly to Commons. A year ago it could take months/years before they were deleted (there was more than 30.000 files). Some hardworking admins have been working nonstop for weeks and at the moment files are deleted the same day. --MGA73 (bincang) 15:11, 4 Mei 2011 (UTC)

And thank you for raising the question about temporary admins. Personally I would prefer to focus on the "NowCommons" files because they can be deleted without problems. The unused fair use are harder because they can be "saved" by adding the files to an article. I think that local users are better to decide where a file would be useful. If there are not enough local admins that can spend time to work on fair use files etc. then I will ofcourse be willing to work on those files too but it will take more time than the NowCommons files. --MGA73 (bincang) 15:32, 4 Mei 2011 (UTC)

Blocked without a notice

Hi! User:Malekhanif just blocked Zscout370 without a warning and without a notice why. Malekhanif never commented the notes I added on Perbincangan_Pengguna:Malekhanif so I'm not sure how well Malekhanif understand English. I think Zscout370 was blocked because he made this edit [2]. Photo requests

Hi! I read your note back in February about the accessibility of the places at the Kuala Lumpur airports. If it is not possible for people to access the buildings themselves it is okay if the photograph the entrances to the buildings. E.G. when a British person found that he could not photograph the head office of the en:Air Accident Investigation Branch in the UK, I told him it would be okay if he got the main gate. Oh, that's not what I mean, I don't know whether it is possible or not for people to access the buildings. What I mean is the airports aren't in the city, you don't go there unless you're flying. I'm aware that the airports are not in the city center. Some Wikipedians who live in the center city may be willing to drive out to the airports just to get photos, and some Wikipedians who live in the center city are not willing to, so it may depend on who I ask

Sorry, I moved Ratatouille to Ratatouille (film), but I forgot the spelling in Malay for film is filem so I had to fix it, could you delete the incorrect redirect? Also, on all the pages, I don't think the talk pages need redirects either? And here's another incorrect one: Charlotte's Web (filem) redirects to Charlotte's Web (filem 1973), but there are two movies named Charlotte's Web, and that redirect was moved by a vandal account. Deletion of files in the subcategories of Kategori:Rencana untuk dipadamkan

Hi! There are some files in the subcategories of Kategori:Rencana untuk dipadamkan. As I understand it this should all files without a license or with an invalid fair use rationale. Before I start deleting the files I would like to hear if that is correct and if you have an idea how to do it. It would be best if files are checked one by one before they are deleted. It certainly would be best if the files are checked one by one. Plenty of them are still wrongly tagged/categorised. I suppose you can put a notice somewhere (e.g. WP:KKD), but it's probably necessary to inform users who uploaded multiple images in these categories. ...Aurora... 03:14, 2 Jun 2011 (UTC)

Replacable fair use

Prihatin

Assalamualaikum dan Salam Wikipedia birokat Aurora.

Baru-baru ni saya lihat telah banyak rencana-rencana berusurkan lucah seperti Kebogelan, Kebogelan di tempat awam, Fotografi bogel dan lain-lain telah mula bercambah di Wikipedia bahasa Melayu. Malah rencana-rencana tersebut turut memuatkan gambar-gambar bersifat "pornografi" dan "lucah". Saya rasa agak khuatir jika lambakan rencana dan gambar-gambar seperi ini terus bermaharaja lela dalam Wikipedia lebih lebih lagi di Wikipedia bahasa Melayu, saya agak takut nanti ada pihak melabelkan Wikipedia sumber bahan lucah pula.

Bagi pandangan saya, jika bahan lucah itu dapat dikawal ia mungkin lebih bagus, atau setiap satu rencana terbitan yang mungkin mengandungi usur seks dan lucah dapat di WAJIBKAN untuk di tag dengan tag 18sx yang kita ada pada setakat ini.

Kalau kita merujuk kepada polisi NPOV dan POV, ia kelihatan agak OK untuk menerima kehadiran rencana dan imej lucah dan seks seperti ini, tapi pandangan saya mungkin Wikipedia bahasa Melayu mempunyai pendirian yang lain?

Mungkin isu ini kita dapat buka pada umum di Kedai Kopi kita bagaimana? untuk kita membincangkannya.

Isu gambar lucah bukanlah isu birokrat semata2 tapi isu masyarakat WBM seluruhnya, jadi silakan mengutarakannya di Kedai Kopi. Hi Aurora, I think you'd better massively delete Mikako's picts, actually I didn't find anything which could be hosted on Wikipedia, dealing with that it's not eligible for "fair-use" (afaik Promosi is a sort of fair-use) since there are several other ways to get an equivalent picture and, first of all, it doesn't accomply to Wikimedia's EDP (which works on every Wikipedias hosted by WMF), best regards! --Vituzzu (bincang) 21:40, 30 Jun 2011 (UTC)

Pictures were all copyvios since they were tagged as PD, then you start tagging all them as fair-use, then I let fair-use template on those which are acceptable as fair-use (Yosri gave me a pdf about Malaysian law about fair-use) according to EDP.

You may be sceptical about my reasons but I cannot be sceptical about your since I cannot see any argument against deletion.

Again I don't see any answer about *facts*, moving the lights upon other people is an old technique (to escape from question)...even older than copyvio! Actually I didn't change tactics, since I have no sakes in deletion or keeping image, my only point is deleting picts which cannot be hosted on wiki, matter of fact things changed when you start tagging as fair-use some picts, don't you agree they had to be deleted as PD-user?

Here the issues (referring to the upper list notes):

Finally mine is not an attack towards Malay community, e. g. some days ago I had to delete about 40 photos on scn.wiki (I'm a native SCN-speaker) which had been hosted for years! I could not help to notice this discussion. The whole idea of the WMF-resolution is that EDP should be used "to illustrate historically significant events, to include identifying protected works such as logos, or to complement (within narrow limits) articles about copyrighted contemporary works". However, it may also apply for articles for notable individuals but the resolutions says "An EDP may not allow material where we can reasonably expect someone to upload a freely licensed file for the same purpose, such as is the case for almost all portraits of living notable individuals.". Also see Wikipedia:Kriteria kandungan tidak bebas in #1: "Tiada karya setara bebas. Kandungan tidak bebas digunakan hanya apabila tiada karya setara bebas tersedia, atau boleh dihasilkan, yang menyampaikan tujuan ensiklopedia sama."

I agree that the argument may apply to a few people that do not show them self in public but you can not argue that it is not possible to take a photo of popstars. Just check Commons:Category:AKB48.

At the moment there is 2.690 files in Kategori:Imej yang tidak diketahui status hakcipta. As you can see here (Perbincangan Pengguna:Kerina yin) it sometimes help to to inform the uploaders about the missing license. But it takes a lot of time to add manually so I was thinking it could be done with a bot. But I need help translate the standard text form English. Perhaps you can help me translate?

The reason I'm not sure about Templat:Non-free currency is that is says that some currencies are PD and others are not. So the template is perhaps not a license template but some sort of information. So perhaps this template also needs another license. A PD or a fairuse. Adding source when uploading files

The uploads by Pengguna:Firq (above) and this Perbincangan_Pengguna:Smim90#Fail:Sebatik_2.jpg made me think that perhaps it could be made more clear when uploading files that there should always be a source. Either a link or a statment "I made this photo" (or whatever). And files without that statement or a link should be tagges with a "no source" or deleted. In many cases a local template like Template:nolicense is better than me trying to explain it in English. I have the same understanding as you in regard of what Wagino is saying. When I went to the source website, I failed to find any copyright notice too. However, that since the images are from the Indonesian goverment official websites, doesn't the en:Template:IDGov / id:Templat:DU-PemerintahIndonesia apply? What a funny license/tag :-o I'm not even sure I understand what the template means. The file is copyrighted but it is allowed to use in some cases... The tag is a fair use-template so the file is not 100 % free. The template also says that you have to give a fair use-rationale. It should be possible to make a free file and that makes fair use invalid. Just blocked a user

Hi! I just blocked a user Khas:Sumbangan/112.202.66.167 (also check deleted usercontribs) for a short period. That is normally something I would not do on ms-wiki because of the language problems. However, it seemed to me that this was vandalism only and it also seems that no local admin was online. I hope you agree and if not please unblock and let me know. I have a question regarding regarding derivative works, I see no mention at Commons:COM:DW that images like YosriKomikMalaysia.jpg (books on rack) or YosriPameranTamadunIslamKLCC.jpg (event poster), so how are these not free?. Indeed I fould several similar images on Commons (e.g. Fail:2009 new novels in a Berlin bookshop.JPG, Fail:2008 Taipei IT Month Day9 Official Poster.jpg). The reason this is derivative works is that the covers of books or the packages or the posters are copyrighted. Whenever there is a photo or a drawing you can normally asume that it is copyrighted. If you put 100 books on a table and take a photo the single book will probably be en:de minimis but if there is only 2 de minimis would not apply - unless you the photo shows your living room and there just happens to be 2 books lying on the table. It is hard to tell when the book just happens to be there or is not the main subject. I nominated the 2 files you found for deletion on Commons. • Yosri Hikayat Amir hamzah.jpg: Old text on display at Perpustakaan Negara Malaysia. Manuscript itself should be PD-old, but no idea of the display case.

Deletion of files without a license

Hi! Some time ago I added a notice to users that uploaded files without a license. Some are probably not active and some have just not fixed the problem. So there is still a lot left. So far I have only deleted a few of those files. Do you think the time is up so I can start deleting some fore files? If they are PD-old or from xx-wiki I will ofcourse fix the license. I have been working on Kategori:Imej domain awam (self) and instead of about 230 files there is now only 63 left. Uploading files from the Internet as own work or without a source

Hi! As you have noticed I have found several cases where users uploaded files from the Internet without telling about it. On Commons and most wikis users are warned not to do so again and if they do it again they are blocked. Perhaps it could be made more clear on the upload form that uploading internet files as own work or without source is strictly forbidden?

Also this Perbincangan Pengguna:Aplikasi#Fail:Veerapab.jpg worries me. If an admin uploads files as own work the user should not be an admin anymore. So I'm sure that there must be some sort of misunderstanding. Perhaps you could have a look? --MGA73 (bincang) 19:25, 25 Ogos 2011 (UTC)

I moved a tokohindonesia.com-file to Commons and started a deletion request to get a discussion on Commons if the permission is ok or not. Salam, Aurora,, Saya selalu penuntu IPG ingin memaklumkan bahawa logo IPG berbentuk G digunakan disemua IPG Kampus dan IPGM. Jadi, logo IPG Kampus yang berasal dari maktab perguruan tidak lagi digunakan. Hanya logo IPG yang berbentuk G sahaja digunakan. 175.144.78.132

Fair use of stamps

Hi! I noticed that you changed the license on some stamps to fair use. For Lembaran mini there are free files available on Commons and fair use should only be used if it is not possible to illustrate with free files. Yes if the article was about lembaran mini in country x then you need a photo from country x but if the article is about lembaran mini as a general topic then photos from other countries should be usable. And that is why fair use is not easy: "It depends ...". Anyway it is cool that you are working on the files in the deletion category and the files without a license and .... You have really been doing a lot to cleanup. It is a pleasure to check out unused files (unused non-free files), uncategorized files (files without a license), the deletion category etc. Sure there is still files to work on but the list gets shorter and shorter and you do not just choose the easy solotion to look away or click delete, delete, delete without checking if that is the best solution ...

Wonder why...

Hi! Do you have any idea why Fail:Zainuddin bin Maidin.jpg was uploaded without a license and a source? And Fail:Matlob.jpg was uploaded with a "bad license" and no source? It should be very easy to add a source and if it is own work it is also easy to pick a license. When I ask I generally have no luck... I nominated a few files for deletion as you can see here Perbincangan_pengguna:Malekhanif#Files_taken_from_the_web but there is no response. I do not know if it is a language problem, a question of understanding copyright or if it is simply because he thinks I'm so annoying. I can understand that it takes time to fix old uploads but I do not think it is acceptable for a sysop to upload new problematic files so I think something should be done. Kategori:Files nominated for deletion on 2011-11-21

Hi!

At the moment there are almost 200 users who have one or more files in Kategori:Imej yang tidak diketahui status hakcipta (Imej ini tidak memiliki kategori lesen). We tried to inform some of the uploaders with only little result.

As a way to get files without a licensed fixed I nominated 91 files for deletion. I took the files where the uploader had only 1 file in the "no license-category". Getting the files fixed we would reduce the number of uploaders with "bad files" down with almost 50 %.

Some of the files are probably easy to fix. Others will most likely end up getting deleted. My plan is that we try this and see how it works. I expect that doing it this way will give a better result than nominating 2.000 files for deletion at one time.
